Uninsured Motorist vs. Non-UM Herniated Disc Cases

In uninsured or underinsured motorist cases where the defendant is an insurance company that provides uninsured/underinsured motorist benefits, we often see higher average case values than general cases where the defendant is a person. In a previous blog, we discussed the average case value of a herniated disc case in general; in another, we discussed the average case values of uninsured/underinsured motorist cases. In this blog, we will be comparing the average case values of uninsured or underinsured motorist (UM) cases and general herniated disc cases.

According to our study, without excluding defense verdicts and outliers, uninsured motorist cases have an average case value of about $31,000 more than general herniated disc cases. Specifically, of a 100-case jury verdict research sample, the average case value of a UM case was $153,398.78, and the average case value for herniated disc cases not involving UM was $122,105.40.

Our study also showed that uninsured motorist cases have a greater chance of a plaintiff’s verdict, when compared to cases against individuals. This is likely because jurors feel less sympathy for an insurance company as a defendant than they do some a human being who works for a living and simply made a mistake of crashing into somebody else’s car.
