FLORIDA TOWING LAWS

Specific laws apply to towing in Florida, and these must be adhered to for a towing to be considered legal. For example:

  • Only a person or entity regularly engaged in towing can be contracted by a property owner to tow a vehicle.
  • A towed vehicle must be kept at a site within a 10-mile radius of the point of removal in any county with a population of 500,000 or more people, or within a 15-mile radius of the removal point in a county with a population of less than 500,000 people.
  • The site where a towed vehicle is taken must be open from 8am-6pm on all days the company is open for towing services.
  • The entity authorizing or completing the towing must notify local authorities within 30 minutes of completing the towing.
  • Notice of potential towing must be given according to specific standards, set forth in Florida Statute § 715.07, with appropriate signage and information.

The person or company actively towing a vehicle must stop if the vehicle owner/operator seeks a return of the vehicle. This means that the towing company must stop what they are doing if you walk up while they are getting ready to tow or are towing your vehicle. They must give you your vehicle back if you provide a reasonable fee of not more than one-half of the posted towing rate. They must also provide a receipt. If you do not have enough money to pay a reasonable fee, you have the right to retrieve your personal belongings from the vehicle. The towing company does not have the right to restrict your access to your belongings until you pay the fee.
