Florida is a No-Fault Insurance State

It is important to understand that Florida is a “no-fault” state when it comes to car accidents and the question of liability. Any delays in seeking emergency or non-emergency medical care from insurance-specified licensed medical physicians can reduce an injured party’s PIP benefits to zero.

Those who suffer property damage may file a liability claim against an at-fault driver, though, and those who suffer serious and permanent injury may pursue a bodily injury liability claim against the other driver.
